Who is exempt and what violations carry

Three groups are exempt under 36 C.F.R. § 261.50(e), according to the Los Padres National Forest | Monterey Ranger District Emergency Closure Order with Exceptions | Forest Service page. The first group is any Federal, State, or local officer, or member of an organized rescue or fire-fighting force in performance of an official duty.

The second group is owners, lessees, or residents of private land within the Monterey Ranger District Emergency Closure Area, to the extent necessary to access their land, unless the area is under evacuation order by the Monterey County Sheriff or California Office of Emergency Management. The prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart A. A violation is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. The cited statutes are 16 U.S.C. § 551 and 18 U.S.C. §§ 3559, 3571, and 3581.

The order was executed at Santa Barbara, California on September 25, 2026. It was digitally signed by Jeanne Dawson, Deputy Forest Supervisor of Los Padres National Forest.

Know-before-you-go contacts and forest warnings

The alerts page asks visitors to know before they go because unexpected situations can present difficult challenges, and directs emergency reports to 911. It links InciWeb Fire Information and a Fire and Smoke Map. It flags illegal cannabis cultivation as an escalating problem in California national forests, states that vector-borne diseases can be transmitted from insects and other animals, and lists naturally occurring asbestos as a forest topic.

The same page defines four alert levels. Critical means critical danger may be present. Fire Restriction means the agency initiates restrictions or temporary closures to reduce wildfire risk and protect the public. Caution means a notification or warning may impede planned recreation or indicate possible danger or an unpleasant or unsafe situation. Information means a situation is generally not dangerous but could affect plans or concern the public.

The page states that fireworks and explosives, including explosive targets, are always prohibited on national forest lands as part of permanent fire-safety regulations in the Code of Federal Regulations. The Los Padres National Forest | Current Conditions | Forest Service page states that campfire permits are required for campfires, charcoal fires, or portable gas stoves outside designated recreation sites, that permits are free and available online through CAL FIRE and at Forest Service offices, and that campfires must be attended by a responsible person and completely extinguished after use.
